Terms & Conditions

These Terms & Conditions govern your use of the coaching services and website operated by Maximus Wielopolski & Daniel Ruso ("IMPACT", "we", "us"). By using our website or purchasing our services you agree to these terms.

1. Who you are contracting with

You are contracting with Maximus Wielopolski & Daniel Ruso, trading as IMPACT, based in Austria. Contact: hello@impact-mtb.com.

2. The service

IMPACT is a 100% digital service. We provide online fitness coaching and digital training programs for mountainbikers and general fitness clients. Everything is delivered online: digital training plans and documents in your account, video coaching calls over the internet, digital video form reviews, and text-based support via email and messaging.

We do not sell, ship, or deliver any physical goods, equipment, supplements, apparel, or printed material, and we do not provide in-person training, gym sessions, camps, or events. There is nothing to ship and no physical component to any package.

3. Acceptable use

You agree not to misuse the service. In particular you will not:

• use it for anything unlawful, fraudulent, or abusive;
• infringe our or anyone else's intellectual property;
• share, resell, or redistribute your program or account access;
• attempt to interfere with the security or integrity of the service (scraping, probing, malware).

4. Health disclaimer

Our programs involve physical exercise. You are responsible for exercising within your ability and, if in any doubt, consulting a qualified medical professional before starting. You participate at your own risk.

5. Intellectual property

All training content, videos, PDFs, and materials remain our property. You get a limited, personal, non-transferable licence to use them for your own training.

6. Payments, subscriptions, refunds and tax

We sell directly to you. Card payments, invoicing and subscription billing are processed on our behalf by Stripe; we never see or store your card details. All listed prices are in EUR and include any applicable VAT, which is calculated at checkout based on your billing country. Subscriptions renew automatically each month until cancelled, and you can cancel at any time from your account page — access continues until the end of the billing period already paid for. 7. Service level

We work hard to keep the service available and useful, but we don't guarantee it will be uninterrupted or error-free.

8. Suspension and termination

We may suspend or terminate your access if you materially breach these terms, don't pay, or if we detect fraud, abuse, or a security risk. Where reasonable, we'll give you a chance to fix things first.

9. Liability

To the fullest extent permitted by law, we exclude all implied warranties. Our aggregate liability to you is capped at the fees you paid us in the 12 months before the claim. We are not liable for indirect or consequential losses. Nothing in these terms limits liability for fraud, death, or personal injury caused by negligence.

10. Governing law

These terms are governed by the laws of Austria. Disputes are subject to the exclusive jurisdiction of the Austrian courts, unless mandatory consumer law says otherwise.

11. Changes

We may update these terms from time to time. The "last updated" date above will change when we do. Continued use of the service means you accept the update.
